Alternative Dispute Resolution

All lawyers in New Zealand have an obligation to inform clients about alternative means of resolving litigation by processes such as negotiation, mediation and arbitration. Russell is thoroughly familiar with alternative dispute resolution. Russell will advise, advocate and present your case in the best possible light. A great majority of cases are settled by alternative dispute resolution. This is because litigation is costly, stressful, time consuming and an uncertain and slow process. If both sides to a dispute take a reasonable approach a compromise can usually be arrived at which leaves both parties in a better position than if they had taken their chances by continuing the litigation.

Opinions

Russell does a lot of opinion work. Legal opinions state how the law applies to particular circumstances and Russell will give an opinion on how a Court would be likely to decide an issue. Sometimes the answer is clear cut. Often it is not, in which case Russell will provide an opinion on the possible outcomes and on the probabilities involved. An opinion can be an extremely valuable tool in deciding upon whether to instigate, defend or settle litigation.
